Sacramento, CA—July 15, 2026— The Peace Officers Research Association of California(PORAC), representing more than 88,000 public safety professionals across California, has joined the Criminal Justice Legal Foundation’s lawsuit challenging the California Board of Parole Hearings’ newly adopted regulations that create a new administrative pathway for recommendations to recall and resentence incarcerated individuals, including some serving life without the possibility of parole.

The lawsuit contends the Board exceeded its legal authority by adopting regulations that fundamentally alter California’s sentencing framework without authorization from the Legislature.

“These regulations represent an unprecedented expansion of bureaucratic power,” said Anne Marie Schubert, President and CEO of the Criminal Justice Legal Foundation. “When California’s largest law enforcement organization stands alongside victims’ families in challenging these regulations, it sends a powerful message that public safety and the rule of law are at stake.”

PORAC President Brian Marvel issued the following statement:

"Behind every peace officer murdered in the line of duty is a family that has already endured the worst day of their lives. They should never be forced to repeatedly fight to keep a murderer behind bars because an administrative agency decided to rewrite California's sentencing laws. PORAC is joining this lawsuit because victims deserve finality, the rule of law must be respected, and the Board of Parole Hearings has no authority to create a new path to release for California's most dangerous offenders."

The lawsuit seeks to prevent the regulations from taking effect, arguing that the Board of Parole Hearings cannot create a new process for recommending recall and resentencing or commutation outside the authority granted by the Legislature or a vote of the People.

CJLF is joined in the litigation by victims’ family members, law enforcement organizations, and public safety advocates who contend the regulations undermine the finality of lawful criminal sentences, erode victims’ rights, and exceed the Board’s statutory authority.
